Local Walks Terms of Use & Privacy Policy
Local Walks is a walking app compatible to both the android and iPhone. It aims to support an increase in recreational walking for all communities. Unlike most other fitness style or walk apps, Local Walks is non-competitive and tailored to the everyday person. Enabling and supporting more than just the avid walker or runner, to instead target those who walk for reasons beyond the fitness benefits such as for pleasure, adventure, social connectedness and/or a mental time out in nature. It includes a well-designed, descriptive and visual application that encompasses a range of details that are often overlooked yet are key features that provide community members further insight that may assist in the accessibility and utilisation of local walk paths and tracks.
Terms of Use & Privacy Policy
This Terms of Use and Privacy Policy applies to:
a) The Local Walks mobile apps;
b) Social media channels including but not limited to:
i. Local Walks Facebook page;
ii. Local Walks Instagram page;
iii. Local Walks YouTube channel.
These various sites are hereafter referred to as ‘the Local Walks applications’.
1. Terms of Use
The Local Walks applications are owned by the South West Sydney Local Health District (SWSLHD). This agreement describes the terms that govern the use of Local Walks application.
Registration and use of the Local Walks app is voluntary. You are able to cancel your registration by emailing your cancellation request to: SWSLHD-LocalWalks@health.nsw.gov.au
By registering, using, or viewing the Local Walks applications, you agree to the following terms and conditions:
1. Use of the Website
1. You will not post any material which is false, defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise in violation of any law;
2. You will not post any copyrighted material, unless the copyright is owned by you, or you have consent from the owner of the copyrighted material;
3. You will not post messages that could be interpreted as spam, flooding, advertisements, chain letters, pyramid schemes, or any other solicitation;4. You remain solely responsible for any material or content that you post to the site or its forum, including comments, links to third party sites etc. and that you will indemnify and hold harmless SWSLHD in respect of any such material or content;
5. If registering on the Local Walks applications, you will choose a username that is appropriate and inoffensive.
6. You will never give, provide, or otherwise make available your password to another individual, for your protection and for validity reasons. You also agree to never use another member's account to post content, messages or browse this forum;
7. You will not be entitled to any monetary benefit in the event that SWSLHD highlights or otherwise selects your content to be featured on the Local Walks applications (e.g., showing your walk as a 'Featured Walk');
8. You accept that any promotional activities, giveaways, or prizes conducted by third parties on the Local Walks applications shall be the responsibility of the third party and not SWSLHD; and
9. You will not make posts or create walks on Local Walks applications that advertises or promotes commercial businesses without the prior approval of SWSLHD.
2. Content
If you post content or load a walk map onto the Local Walks applications, you provide SWSLHD a permanent, non-exclusive licence to promote and distribute this content, in whole or in part, on an ongoing basis. All content contributors to the Local Walks applications are also informed and in agreement that their work will be held by SWSLHD in a digital archive.
If you are posting content or walks that you discovered in another walking book or website, please ensure the content, or walks you contribute are based on your interpretation and not copied directly (word for word) from the source. You can also credit the original source in your walk summary.
3. Changes
SWSLHD reserves the right to modify these terms of use at any time without prior notice. Rule changes apply to past, current, and future posts.
SWSLHD retains the right to remove or edit content that it reasonably regards as incorrect, objectionable, defamatory or outside the stated purposes of SWSLHD, at any time and at its sole discretion, if it determines that removal is necessary. Content may be partly or entirely removed or edited immediately or at any later time. This policy extends to member profile information.
SWSLHD reserves the right to delete a walk created on Local Walks applications that: does not reasonably constitute a walk (e.g., the walk is plotted across buildings or is mostly a photo/point of interest plotted on a map without a reasonable walk); appears as a ’test’ walk or has a very low rating and has very few views over an extended period of time.
4. Moderation
SWSLHD reserves the right to moderate any content it determines to be in breach of these rules. SWSLHD does not believe in silencing people, and advocates freedom of speech. However, SWSLHD will remove content that is outside the stated purposes of SWSLHD or could otherwise be in breach of these rules. Local Walks reserves its rights to remove or edit content at any time, including a period after the offending material was posted.
5. Links
The Local Walks applications may contain links or references to other Internet sites beyond SWSLHD’s control. Links to other Internet Sites are not under the control of the SWSLHD and are provided for information only. Care has been taken in providing these links as suitable reference resources. However, due to the changing nature of the Internet content, it is the responsibility of the users to make their own investigations, decisions, enquiries about the information retrieved from other Internet Sites. Providing these links does not imply any endorsement, non-endorsement, support or commercial gain by the State of New South Wales.
The SWSLHD takes no responsibility for the accuracy, currency, reliability and correctness of any information included in the Information provided by third parties nor for the accuracy, currency, reliability and correctness of links or references to information sources (including Internet Sites) outside of the Local Walks Applications. SWSLHD disclaims all liability whatsoever for the content of these sites.
2. Privacy policy
South West Sydney Local Health District (SWSLHD), Health Promotion Service - Waranara Building, Eastern Campus, Liverpool Hospital, 52 Scrivener St, Warwick Farm 2170 will collect information you provide through the Local Walks applications. By providing your personal details to SWSLHD through the Local Walks applications you signify your acceptance of this Privacy Policy.
If you do not agree to this Privacy Policy, please do not provide your personal details.
This Privacy Policy is incorporated into, and is part of, the Terms of Use that govern your use of the Local Walks applications in general.
SWSLHD will collect, use and disclose your information as specified in this Privacy Policy. The SWSLHD is governed by the Privacy and Personal Information Protection Act 1988 and applicable NSW Health privacy policies. You can unsubscribe whenever you receive a communication from SWSLHD (e.g., our emails) by sending an email to SWSLHD-LocalWalks@health.nsw.gov.au with ‘unsubscribe’ in the subject box.
SWSLHD may need to update this Privacy Policy from time to time. Please check this page regularly to ensure that you have read the most recent version.
1. Collecting personal information
SWSLHD will only collect the personal information that you choose to provide to us. Where possible, SWSLHD will enable you to select how this information will be used. You may choose to provide personal information if, for example, you: make an enquiry; register on the Local Walks applications, fill out a survey or other form with your personal information included; request information; enter a competition; post information to public areas of the Local Walks applications; or participate in a promotion.
All data collected is via the app signup process and completion of the user profile. Such data is stored in AWS Data Centres (Sydney Region). By providing any personal information to SWSLHD, you fully understand and clearly consent to the transfer of such personal information to, and the collection and processing of such information in, other countries or territories for the purpose of maintaining, improving and evaluating the local walks mobile app. Any such transfer and processing by SWSLHD will be in accordance with this Privacy Policy. Third parties (including but not limited to software providers, advertisers, and ad placement agencies) may also use tracking technologies by or through the Local Walks applications.
If users Login to the Local Walks mobile application their data is collected, processed, and used in the following ways for these purposes:
- Facebook ID
- saved to database held by SWSLHD
- this is used to identify the user
- depending on user’s login selection
- Google ID
- saved to database held by SWSLHD
- this is used to identify the user
- depending on user’s login selection
- Apple ID
- saved to database held by SWSLHD
- this is used to identify the user
- depending on user’s login selection
- email address
- saved to database held by SWSLHD
- this is used to send a verification email so that a walk that has been created can be published
- first and last name
- saved to database held by SWSLHD
- this is used as the Display name on a published walk, a walk review or other content e.g. photos (users are able to change their Display name on Local Walks)
- height & weight metrics
- saved to database held by SWSLHD
- this is used to calculate calories expenditure
- Users who choose to not add height and weight metrics will not be able to receive calorie expenditure calculations.
Users who choose not to provide either their Facebook ID, Google ID, Apple ID or email, or provide a display name will not be able to log in and access the Local Walks mobile application.
2. Our use of personal information
SWSLHD will use information collected from you in the following ways:
Marketing purposes - SWSLHD may use information for internal marketing analysis, for example, to assess trends amongst our visitors or to measure the amount of traffic to the Local Walks applications. SWSLHD may also use your personal information to communicate with you about its services or those of its affiliates or walking in general. However, you will be able to choose whether to receive such communications when you first provide personal information to SWSLHD.
Transactional purposes - SWSLHD may use your personal information to respond to your queries and requests.
Public (or interactive) areas of the Local Walks applications- Information that you post on or through the public areas of the Local Walks applications (e.g., walk reviews) are generally accessible to, and may be collected and used by, others and may result in unsolicited messages or other contact from others. Users of the Local Walks applications are encouraged to exercise caution when providing personal information about themselves in public areas of the Local Walks applications.
Administration and data management - SWSLHD may transfer your personal information to third parties under confidentiality obligations when the performance of any service in relation to the activities under item 2 of this Privacy Policy is sub-contracted (e.g., the administration of a marketing campaign for SWSLHD).
Legal purposes - SWSLHD may use or disclose your personal information if permitted by law or required to do so by law.
3. Use of cookies
In common with many mobile applications, SWSLHD uses "cookies" to help us gather the following information from visitors for example:
• the IP address from which you access the Local Walks applications
• the type of browser and operating system used to access the Local Walks applications
• the date and time of your access to the Local Walks applications
• the pages you visit
• the internet address of the website from which you accessed the Local Walks applications
A cookie is a small data file that our server sends to your browser when you visit the Local Walks applications. The use of cookies helps SWSLHD to assist your use of certain aspects of the Local Walks applications. You can delete cookies at any time, or you can set your browser to reject or disable cookies. If you do disable cookies some functions on the Local Walks applications may not work correctly. SWSLHD uses information from cookies, for example, to learn about the number of users of our Local Walks applications and the type of technology that our users use. Cookies help us to monitor what sort of content is popular and to assess users browsing habits. When a user revisits the Local Walks applications, SWSLHD may recognise the user by the cookie and customise the user’s experience accordingly. SWSLHD can use this information to continually improve the content and usability of the Local Walks applications. SWSLHD may compile and report to third parties (such as evaluators) aggregate statistics about our users in terms of numbers, traffic patterns and related Website information. SWSLHD does not connect the information collected through cookies with other information that is personally identifiable, unless required or permitted to do so by law or to enforce the Terms of Use.
4. How we protect your information
SWSLHD takes security seriously and exercises precautions to keep your personal information secure. SWSLHD has put in place appropriate physical, electronic, and managerial procedures to safeguard the information collected. However, due to the open communication nature of the Internet, SWSLHD cannot guarantee that communications between you and Local Walks, or information stored on Local Walks servers, will be free from unauthorised access by third parties.
5. Your details and contacting us
You can check what personal information SWSLHD holds about you, update your information, ask SWSLHD to cancel your registration and remove your personal information, correct any inaccuracies in such personal information or ask SWSLHD questions about our Privacy Statement, by contacting SWSLHD-LocalWalks@health.nsw.gov.au or (02) 4621 8701. Other options provided, should you wish to request deletion of your account and information is by requesting this through the app user settings. SWSLHD will make every effort to respond to your request in a timely manner.
